1. PERFORMANCE OF SERVICES

(a) The client must provide:

(i) A safe and adequate space for the dancer. This includes a floor or stage that has at least 4x4 meters of space, clear of any obstacles or low hanging objects, and free of broken glass, spilled liquids, or any other hazardous objects.

(ii) An environment that is free of harassment of a sexual nature or otherwise. If the dancer deems the environment unsafe for this reason or any reason mentioned in (a):

(ii) they may leave without rendering services. In that case, the client will still be responsible for paying the full amount.

(iii) A private and secure space to change clothes and to store belongings during the performance. The client, or a person acting on behalf of the client, is to show the dancer this space upon arrival.

(iv) An adequate sound system. It is the responsibility of the client to provide a sound system capable of playing songs, to a volume that is deemed acceptable by the dancer, from a USB. If the Client wishes to have access to the music prior to the performance, they must communicate this at least one week in advance. All songs have been edited and cannot be streamed from any online service. The dancer can provide a speaker if necessary, this speaker is not suitable for larger venues and requesting this must be done prior to the performance.

(v) Any special suggestions or requests must be communicated by the client at least 1-2 weeks prior to the event. The show has been specifically planned with music chosen and it is difficult to make significant changes on the day of the performance

(b) The dancer will often have several engagements in a night, so it is important that the client ensures that the show begins at the agreed upon time. If the dancer is required to start more than 30 minutes after the agreed upon time, a charge of $50 will apply. Extreme lateness may result in a shorter performance or constitute a breach of contract.

(c) Tips are accepted and welcomed. If guests choose to tip, they may do so by throwing bills in the air above the Dancer’s head, or by handing them to her. Any tips should be collected after the show and turned over to the dancer. All tips collected by the dancer belong to her and are not deducted from the final fee.

2. RESPONSIBILITIES OF THE DANCER

(a) If for any reason there is a delay in arrival time, the dancer will call the phone number provided by the client to inform the hiring party of the delay.

(b) Be assured that, if appropriate, audience participation song(s) will be included in the performance. Guests of honour will be invited to the stage, but the dancer will not force those who are uninterested in participating.

(c) In the event the dancer is unable to perform due to sickness or accident, they may cancel the performance and return any and all outstanding deposits to the client. Auckland Belly Dance reserves the right to switch the scheduled performer or cancel in the case of a serious emergency, inclement weather, or other legitimate condition beyond their control.

(d) The dancer will often be accompanied by an assistant. This is for security, assisting with costumer change and acting as a safety spotter for fire performances.

3. VIDEOGRAPHY AND PHOTOGRAPHY

If the client or any person at the event wishes to video or photograph the show, they may do so for personal use. Any recordings or photographs shall not be used for commercial purposes, or posted to social media, without the dancer’s permission.

4. PAYMENT

(a) A non-refundable deposit (30% of the total fee) is due upon making the booking to secure the performance. The booking is not confirmed unless this payment has been received. The remaining amount is due one week prior to the scheduled performance. This is payable to Auckland Belly Dance Ltd, 06-0115-0428787-00.

(b) Cash will not be accepted as payment for the performance on the day of the event.

5. CANCELLATION

Any cancellations or reschedules made less than 7 days prior to your event will result in a cancellation fee equal to 50% of the total cost. Cancelling later than 24 hours prior to the show will result in a charge equal to 100% of the reserved service amount.

6. FORCE MAJEURE

Neither the dancer not the client will be held liable for any failure to perform its obligations under this Agreement where such breach is due to any of the following: inclement weather, epidemic, interruption or delay of transportation service, acts of God, or any other legitimate cause beyond the reasonable control of either party.

7. NON-PERFORMANCE BY THE CLIENT

The obligations of the client contained in clause 1 are required to be met and are conditions precedent which must be satisfied by the client before the event for the dancer to be required to complete their services, unless otherwise agreed to by all parties in writing. If the client cancels or postpones the performance, without proper notice, or fails to make any payment or fails to meet any of the terms contained in clause 1, or perform any other condition precedent as required by this agreement, then the client will be in breach of this agreement and the dancer will have no further obligations under this agreement.

8. AMENDMENTS.

No amendment to this agreement will be effective unless it is in writing and signed by the client and the dancer.
